1. Introduction and Overview

Bright Ideas Community, doing business as Bright Ideas Company ("Bright Ideas Company," "we," "our," or "us") respects your privacy and takes seriously the information people trust us with.

This Privacy Notice explains what information we collect, how we use it, who we share it with, and what choices you have. It applies to people who visit wemakebright.com, contact us through the site, hire us, work with us, appear in photography or video we produce, or communicate with us by email or phone.

Bright Ideas Company is a marketing agency based in Chicago. We run seven service lines: Brand Strategy, Film and Video, Photography, Brand Design, Web Design and Development, Paid Media, and Brand Growth. Because our work includes producing photography and film of real people at real events, this notice covers something most agency privacy notices leave out. See Section 3, Production Media, Likeness, and Releases.

What this notice does not cover:

  • Employment applications, hiring, and personnel information. Those are handled separately.
  • Information we process purely on a client's behalf as their service provider. When a client hires us to produce or manage assets, that client decides how the finished work is used, and their privacy notice governs it. Ours governs how we hold and protect the files while they are with us.
  • Third party websites you reach through links on our site. See Section 12.

2. Information We Collect

Information you give us directly

Contact and inquiry information. Your name, business name, role, email address, phone number, and whatever you write into a contact form, project inquiry, or email. If you tell us about your project, your budget range, or your timeline, we keep that with the inquiry.

Engagement information. If you become a client: billing contact details, project briefs, creative direction, approvals, revision notes, files you send us, meeting notes, and the working record of the engagement.

Payment information. We invoice through Square. Square collects and processes card and bank details directly under its own terms. Bright Ideas Company does not store full card numbers or bank account numbers.

Scheduling information. If you book a call or a shoot with us, we collect the details needed to hold that time.

Social media interactions. If you message us, tag us, or comment on our accounts, we see what those platforms show us.

Information captured during production

Photographs, video footage, and audio recordings of people, locations, and events, captured on shoots and at events we cover. Names, titles, and contact details of on camera subjects and crew, collected through call sheets, release forms, and production paperwork. Section 3 covers this in full.

Information collected automatically

When you visit wemakebright.com, we automatically receive technical information including your IP address, browser type and version, device type, operating system, screen size, the website that referred you, the pages you viewed, how long you stayed, and the links you clicked. This is collected through cookies and similar technologies. Section 5 explains how, and how to turn it off.

What we do not collect

We do not collect Social Security numbers, driver's license numbers, passport numbers, or other government identification numbers. We do not collect precise device geolocation. We do not collect health information. We do not purchase personal information from data brokers or list vendors.

3. Production Media, Likeness, and Releases

Our work involves recording real people. This section explains exactly how we handle that, because it is the part of our business that touches the most people and the part most agency privacy notices skip.

When Bright Ideas Company controls the production

On productions where we are the producer, every identifiable person whose likeness will appear in a deliverable signs a written appearance release before the work is used. The release states where the footage may run, for how long, and in what territory.

At large public events where individual releases are impractical, a general filming notice is posted at the entry points and stated in the run of show, so attendees know that the event is being recorded before they walk in. If you are at an event we are covering and you do not want to be filmed, tell any member of our crew.

When Bright Ideas Company works through a client or a partner agency

Many of our engagements run through a client or a partner agency that holds the client relationship. On those engagements, that party typically owns the footage and directs how it is used. We capture and handle the media on their behalf under our agreement with them. Their privacy notice governs the finished work. This notice governs how we store, protect, and dispose of the files while they are in our possession.

Minors

We do not film or photograph an identifiable minor for a deliverable without written consent from a parent or legal guardian.

Facial recognition and biometric identifiers

Bright Ideas Company does not run facial recognition, face geometry mapping, voiceprint analysis, iris scanning, or any other biometric identification on the media we capture. We do not use biometric identifiers to search, sort, tag, or index footage. We do not sell, lease, trade, or otherwise profit from biometric information.

Generative AI

We use generative tools for visual effects, motion graphics, type treatments, product macro shots, and transitions. We do not generate synthetic faces, synthetic voices, or synthetic likenesses of real people. We do not train AI systems on client footage or on images of the people who appear in it. Real people, real venues, and real events are always captured on camera.

Retention of raw media

Raw camera files and unedited images are held for 24 months after final delivery, then deleted unless licensed or purchased by the client or retained under the terms of the engagement. Finished deliverables may be held longer as portfolio and case study material where the engagement permits it.

Removing your likeness

If you appear in work Bright Ideas Company produced and you want your likeness removed, contact us using the details in Section 14. Where we control the asset, we will act on the request. Where a client owns the asset, we will forward the request and tell you who received it.

4. How We Use The Information

We use the information we collect for the following purposes:

Responding to you. Answering inquiries, scheduling calls, sending proposals, and handling questions about our work.

Running the engagement. Producing and delivering the work, managing scope and approvals, coordinating crew and locations, and communicating throughout the project.

Billing. Issuing invoices, processing payments, collecting on overdue accounts, and keeping the records our accountants and the tax code require.

Operating and improving the website. Keeping wemakebright.com working, understanding which pages people use, and fixing what does not work.

Marketing our own services. Sending newsletters and updates you asked for, publishing case studies and portfolio work where the engagement permits, and measuring whether any of it lands.

Security and fraud prevention. Protecting our systems, our files, and our clients' assets.

Legal compliance. Meeting our obligations under applicable law, responding to lawful requests, and enforcing our agreements.

We may also use information in other ways where we tell you at the point of collection or where you have given consent.

5. Cookies and Analytics

We use cookies and similar technologies to keep wemakebright.com working and to measure how the site is used.

Our Cookie Policy lists every category we set, who sets it, how long it lasts, and how to turn it off.

You can block or delete cookies at any time through your browser settings.

6. Information We Disclose

We do not sell your personal information. We do not share it for cross context behavioral advertising. We disclose information in the following situations.

Service providers

We use vendors to run the business. They receive only what they need to do their job and they are not permitted to use it for anything else.

Clients and partner agencies

Where we produce work for a client or through a partner agency, we deliver the media and the associated production paperwork to that party. Once delivered, their terms govern how it is used.

Crew and subcontractors

Producing film and photography requires crew. Where a subcontractor needs information to do the work, such as a call sheet with on camera subject details, they receive it under a written agreement that limits what they may do with it.

Professional advisors

Our attorneys, accountants, and insurers, where they need the information to advise us.

Legal compliance and protection

We disclose information where required by law, subpoena, court order, or lawful government request. We also disclose where we reasonably believe it is necessary to enforce our agreements, investigate suspected fraud or a security issue, or protect the rights, property, or safety of Bright Ideas Company, our clients, or others.

Business transfer

If Bright Ideas Company is involved in a merger, acquisition, financing, reorganization, or sale of assets, information covered by this notice may transfer as part of that transaction. It stays subject to the commitments made in this notice unless and until you are told otherwise.

7. Email and Text Communications

Email

If you subscribe to our newsletter or ask to hear from us, we send updates about our work, our services, and what we are building. Every marketing email carries an unsubscribe link. Unsubscribing stops marketing email. It does not stop transactional messages about an active project, an invoice, or a scheduled shoot.

Unsubscribing does not remove your information from our records. It marks you inactive for marketing.

8. Your Privacy Rights

Depending on where you live, you may have rights over the information we hold about you. Bright Ideas Company extends the core of these rights to anyone who asks, regardless of state.

Right to know. Ask what personal information we have collected about you, where it came from, why we collected it, and who we shared it with.

Right to access. Request a copy of the personal information we hold about you.

Right to correct. Ask us to fix information that is inaccurate.

Right to delete. Ask us to delete personal information we collected from you. We may keep what the law requires us to keep, such as tax and accounting records, and what we need to complete a transaction or defend a legal claim.

Right to portability. Request your information in a portable format where technically feasible.

Right to opt out. Opt out of marketing communications, and of targeted advertising where it applies.

Right to appeal. If we deny a request, you may ask us to reconsider. We respond to appeals in writing with our reasoning.

Right to remove your likeness. If you appear in media we produced, see Section 3.

How to exercise your rights

Email us at info@wemakebright.com or write to the address in Section 14. Tell us what you are asking for and give us enough information to find your records.

Verifying your request

We verify that a request comes from you, or from someone you authorized, before we act on it. Depending on what you are asking for, we may ask you to confirm details we already hold. An authorized agent may act for you, and we will verify their authority before proceeding.

What we may not be able to do

We may deny a request in whole or in part where the law permits it. Examples include information we are required to retain for tax, accounting, or legal reasons, and information whose deletion would break an agreement we are still performing. We will tell you why.

No discrimination

We do not discriminate against anyone for exercising a privacy right. We will not deny you services, charge you a different price, or give you a lower quality of service because you made a request. In some cases we may be unable to provide a service without certain information, and we will say so plainly.

We keep information for as long as we need it for the purposes described in this notice, and then for as long as the law requires.

When we no longer need information, we delete it or render it unreadable.

10. Data Security

We use administrative, technical, and physical safeguards designed to protect the information we hold. That includes access controls on our systems and storage, encryption in transit, restricted file sharing, and vendor agreements that hold our service providers to the same standard.

No system is perfectly secure and we do not claim ours is. If we learn of a breach affecting your personal information, we will notify you and the appropriate authorities as required by law.

If you believe your interaction with us is no longer secure, contact us immediately using the details in Section 14.

11. Information From Children

Our services are built for businesses and organizations and are directed to adults who are 18 years of age or older. We do not knowingly collect personal information from children under 16 through wemakebright.com.

If you believe a child under 16 has given us personal information through our website, contact us and we will delete it.

Filming and photographing minors on a production is governed separately. See Section 3.

13. Changes To This Notice

We may update this Privacy Notice as our business, our tools, or the law changes. When we do, we change the Last Updated date at the top of this page and post the revised notice here.

If we make a material change, we will give notice before it takes effect, by email where we have your address or by a notice on wemakebright.com.

Check this page from time to time. Continued use of our services after a change takes effect means you accept the revised notice.
